GENERAL TERMS AND CONDITIONS OF SALE

The products presented on the PIER AUGE FRANCE SAS website accessible via "www.pieraugeparis.com" (hereinafter, the "Site") are sold directly by the company PIER AUGE, a simplified joint-stock company with a capital of 100 euros, whose head office is located at 253 rue Saint-Honoré 75001 Paris, registered in the Trade and Companies Register of (Paris) under number 941 284 838 R.C.S.
These General Terms and Conditions of Sale govern any visit and order placed on the Site by a consumer, i.e., any natural person who acts for purposes that do not fall within the scope of their commercial, industrial, artisanal, liberal, or agricultural activity within the meaning of the introductory article of the Consumer Code (hereinafter "You"). If You are not a "consumer," we invite You to refrain from conducting commercial transactions on the Site and to contact us via (email) to obtain the conditions applicable to Your situation.
You must be at least 18 years old and have the legal capacity or be the holder of parental authorization allowing You to place an order on the Site. PIER AUGE reserves the right not to process orders from any person who is not a "consumer."
The General Terms and Conditions of Sale in force are those accessible on the day of the validation of the order. They may be modified at any time, particularly in consideration of any legislative changes. The new general terms and conditions of sale will apply on their date of publication on the Site.
If you disagree with any terms indicated in these General Terms and Conditions of Sale, PIER AUGE invites You not to validate Your order form. By validating Your order form, You confirm that You have read and accepted these General Terms and Conditions of Sale without reservation.
ARTICLE 1 – PRODUCTS AND PRICES
1.1. PIER AUGE offers a range of products that may change at any time at the sole discretion of PIER AUGE (hereinafter, the "Products").
1.2. Our product offers are valid as long as they are online and are offered within the limits of available stock.
1.3. The photographs and texts appearing on the Site, illustrating the Products presented, are not contractual and may have been retouched.
1.4. The characteristics of each Product are detailed on the Site.
1.5. The prices of our Products are indicated in Euros, including all taxes, excluding delivery charges.
1.6. The Products offered comply with the French legislation in force. In the event of an order to a country other than metropolitan France, You are the importer of the product(s) concerned. Customs duties, local taxes, import duties, or state taxes may be required and will remain Your responsibility. They are Your sole responsibility in terms of declaration and payment to the competent authorities and organizations of Your country. We advise You to inquire about these aspects with the local authorities.
1.7. When ordering from outside metropolitan France, You acknowledge and accept that You are acting as the importer of the Product(s). You are solely responsible for complying with all applicable local laws, customs duties, import taxes, and other charges related to the importation of goods into Your country. PIER AUGE cannot be held responsible for non-compliance with local regulations or for any customs-related issues that may arise.
1.8. The Site reserves the right to modify the prices at any time. The applicable prices are those in effect at the time of the validation of Your order by You.
ARTICLE 2 – ORDER PROCESS
2.1. To validate Your order, You must follow these steps:
- Step 1: Visit the Site, view the Products and their characteristics.
- Step 2: The Products You have selected are placed in Your cart according to the quantity requested.
- Step 3: Create Your online account by filling out the form and following the instructions. For any new order, it is Your responsibility to verify and, if necessary, update the personal data in Your account.
- Step 4: You must verify the contents of Your cart as well as the quantity of Products ordered and correct or modify if necessary. Before validating the cart, take note of the total amount of Your cart, including delivery charges depending on the shipping method You have chosen, as well as the General Terms and Conditions of Sale.
- Step 5: Validating the cart, including the shipping method, triggers the payment process for the order. You are then redirected to the online payment server to proceed with the payment.
- Step 6: PIER AUGE sends You an email confirming Your order.
2.2. The contract is deemed to be concluded at the time of the validation of the order and is valid for the duration necessary for the execution of the order, until the expiration of the guarantees and obligations due by the parties.
2.3. The data recorded by the Site during the validation of orders constitutes proof of all transactions carried out by the Site and its customers. The data recorded by the payment system constitutes proof of financial transactions.
ARTICLE 3 – AVAILABILITY OF PRODUCTS AND VALIDATION OF THE ORDER
3.1. It is Your responsibility to verify during the ordering process, item by item, that the quantity and price are correctly taken into account in the order form.
3.2. If a Product is no longer available, PIER AUGE will inform You by email of this unavailability and will propose terms in accordance with the "Delivery" article.
3.3. PIER AUGE reserves the right to refuse any order whose quantities would be abnormally high or if PIER AUGE has encountered payment problems with this consumer during a previous order.
ARTICLE 4 – PAYMENT
4.1. All orders must be paid in Euros on our secure transaction platforms PAYPAL or Shopify payment. PIER AUGE will accept Your online payment made with one of the following payment methods: Visa, MasterCard, American Express, or PayPal. Your payment is encrypted and secured by Shopify or PayPal. By providing the information related to Your bank card, You authorize PIER AUGE to debit the said bank card for the amount corresponding to the total price including VAT of Your order.
4.2. For a total amount exceeding 800 Euros, additional information may be requested from You.
4.3. You confirm that You are the holder of the bank card debited and that the name appearing on the bank card is effectively Yours.
4.4. In the event of failure to debit the total price including VAT of the order, PIER AUGE reserves the right to cancel the order without delay. You will then have to place a new order with a valid payment method.
4.5. The Products remain the property of PIER AUGE until the full payment of the price including VAT.
4.6. The telecommunication costs related to accessing the Site remain Your sole responsibility.
ARTICLE 5 – DELIVERY
5.1. It is Your responsibility to ensure the accuracy of Your details when placing Your order: name, complete delivery/billing address, email address, and telephone number. Delivery will take place at the delivery address You have indicated in the order form.
5.2. PIER AUGE delivers to France, Austria, Belgium, Czechia, Germany, Denmark, Spain, Finland, Greece, Hungary, Ireland, Italy, Netherlands, Poland, Portugal, Romania, Sweden, Slovakia.
Shipping costs are calculated based on the delivery method and destination chosen.
For deliveries within mainland France, we are pleased to offer complimentary standard shipping on all orders over €50. For deliveries to Austria, Germany, Ireland, the Netherlands, and Portugal, we are pleased to offer complimentary standard shipping on all orders over €80.
For orders below this amount, a base shipping fee starting from €5.95 will apply. The exact shipping costs will be clearly displayed in your basket before the final validation of your order. For other destinations, shipping costs vary by region and will be calculated at checkout.
5.3. Processing & Delivery Times:
5.4. When the parcel is sent, we will send You the corresponding tracking number by email. From departure to arrival, You have the possibility to track Your parcel by entering its tracking number on the carrier's website.
5.5. Customs fees and other taxes due in the country of arrival are Your responsibility and cannot engage the responsibility of PIER AUGE in case of customs retention of the Product.
5.6. Upon receipt of the parcel, You must verify the conformity of Your order. Any anomaly concerning the product references delivered must be reported on the receipt presented by the carrier and must be notified on the same day, or at the latest on the first working day following delivery, to PIER AUGE's customer service (email).
5.7. If you notice any damage or anomaly regarding the delivered products, we invite you to report it to the carrier upon receipt. In accordance with Article L.224-65 of the French Consumer Code, you have a period of seven (7) days following delivery to notify our Customer Service of any reservations or defects. This ensures we can provide you with a prompt solution, such as a replacement or refund.
5.8. In the event of a delivery delay exceeding 30 days, Pier Augé will contact you via email or telephone to discuss the status of your order. You may choose to cancel your order and receive a full refund by simply sending an email to our Customer Service team. The refund will be processed within 14 days of your request.
ARTICLE 6 – WITHDRAWAL / RETURN / EXCHANGE
6.1. PIER AUGE is committed to providing You with high-quality products. Despite this, if You are not satisfied with Your order, You have a period of fourteen (14) days from the receipt of the Products to exercise Your right of withdrawal without giving any reason.
However, in accordance with Article L221-28 of the French Consumer Code, this withdrawal right does not apply to sealed skincare products which have been opened or unsealed by You after delivery, for health and hygiene reasons.
To exercise Your right of withdrawal, You must inform us of Your decision to withdraw from the contract by sending us the withdrawal form, or Your return or exchange request by email to (email), indicating the number and date of the order, Your first and last name, delivery address, and the Products concerned.
PIER AUGE will acknowledge receipt of Your withdrawal request promptly upon receipt.
6.2. Once Your withdrawal request is received, PIER AUGE will inform You of the detailed procedure to follow. Products must therefore be returned unopened, unused, and in their original packaging within fourteen (14) days following PIER AUGE’s acknowledgment of Your withdrawal.
PIER AUGE will reimburse all payments received from You, including standard delivery costs, within fourteen (14) days of receiving the returned Products.
PIER AUGE may refuse the return, refund, or exchange of any product that has not been received within this period or that is incomplete, opened, used, or damaged, or whose original packaging has been damaged by You.
6.3. Any risk related to the return of the Product(s) is Your responsibility.
6.4. Return shipping costs are Your responsibility. PIER AUGE will not accept parcels sent cash on delivery.

ARTICLE 7 – WARRANTIES
7.1. In accordance with Article L.217-4 and following of the Consumer Code, PIER AUGE is required to deliver a Product that conforms to the order and to be responsible for defects in conformity existing at the time of delivery.
According to Article L.217-5 of the Consumer Code, the Product is conform if:
1° it is fit for the purpose for which goods of the same type are normally intended and, where applicable:
- it corresponds to the description given by PIER AUGE and has the qualities presented in the form of a sample or model;
- it has the qualities that a buyer can legitimately expect given the public statements made by the seller, the producer, or their representative, particularly in advertising or labeling;
2° or it has the characteristics defined by mutual agreement between the parties or is fit for any special use sought by the buyer, brought to the seller's attention, and accepted by the latter.
Article L.217-3 of the Consumer Code provides that "the action resulting from the lack of conformity is time-barred two years from the delivery of the goods."
7.2. Furthermore, according to Article 1641 of the Civil Code, "the seller is liable for hidden defects in the thing sold which render it unfit for the use for which it is intended, or which so diminish this use that the buyer would not have acquired it, or would have paid a lower price, if they had known them."
7.3. If the Product(s) are non-compliant under the conditions provided for in Article 7.1 of these terms or if they have hidden defects within the meaning of Article 7.2 of these terms, You must exercise these warranties by sending Your request to (email) to notify the non-conformity or hidden defects of the Product(s). PIER AUGE will acknowledge receipt of Your request and inform You of the steps to follow in this process.
Any return of Products will be made under the same conditions as those provided for in Articles 6.2 and 6.3 of these terms.
7.4. Following the verifications made by PIER AUGE, if the non-conformity of the Product is confirmed, You will have the choice, in accordance with Article L217-9 of the Consumer Code, between the repair or replacement of the Product. However, PIER AUGE reserves the right not to proceed according to Your choice if this choice results in a manifestly disproportionate cost compared to the other method, considering the value of the Product or the nature and extent of the defect. In this case, PIER AUGE will proceed with the alternative remedy.
If non-conformity or a hidden defect is confirmed, You may choose between the termination of the sale or a reduction in the sale price in accordance with Article 1644 of the Civil Code. PIER AUGE will bear the costs of returning the defective Product as well as the delivery of the repaired or replacement Product.
ARTICLE 8 – INTELLECTUAL PROPERTY
In general, the trademarks, whether figurative or not, and more generally all logotypes, images, symbols, and illustrations appearing on the Site and/or on the Products, their packaging, whether registered or not, (collectively, the "Intellectual Property Rights") are and remain the exclusive property of PIER AUGE.
Any reproduction, copy, dissemination, modification, or use, in whole or in part, of these Intellectual Property Rights, for any purpose and on any medium, without the express and prior agreement of PIER AUGE, is strictly prohibited.
The same applies to any combination or conjunction with any other trademark, symbol, logotype, and more generally any distinctive sign intended to form a composite logo. The same applies to any copyright, design, model, and patent that are the property of PIER AUGE or for which PIER AUGE holds the rights.
ARTICLE 9 – PERSONAL DATA PRIVACY
We process your personal data specifically for order processing, payment handling, customer relationship management, product delivery, after-sales service, legal compliance obligations (such as accounting records retention), and marketing and promotional purposes (only with your explicit consent). Unless otherwise stipulated by law, we retain your data for the following periods:
- Transaction-related data: up to 5 years after transaction completion.
- Marketing data: up to 3 years from your last interaction.
- Accounting and tax-related data: up to 10 years

In a continuous effort to improve our content and services, we track the frequency of visits through the Google Analytics tool. The data collected is anonymous and is used solely for statistical analysis purposes.
ARTICLE 11 – LIMITATION OF LIABILITY REGARDING TRANSACTIONS
PIER AUGE’s liability in relation to any product purchased through this website is strictly limited to the purchase price of that product. PIER AUGE shall not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities arising from or connected to the sale, use, or misuse of the products purchased.
PIER AUGE will not be responsible for any delay or failure to comply with its obligations under these Terms of Sale if such delay or failure arises from any cause beyond its reasonable control (force majeure), including but not limited to strikes, civil unrest, natural disasters, pandemics, and transportation disruptions.
This clause does not exclude or limit any liability that cannot be excluded or limited under applicable law.
Article 12 - FORCE MAJEURE
12.1. The performance of PIER AUGE's obligations under this contract will be suspended in the event of Force Majeure for the entire duration of the Force Majeure, including in the event of disruption, flooding, fire, or strike, particularly of postal services and means of transport or communication. Therefore, PIER AUGE will not be liable for any direct or indirect damages related to such events beyond its control.
12.2. When the suspension of the performance of PIER AUGE's obligations continues for a period exceeding ninety (90) days, You have the possibility to terminate the current order, and PIER AUGE will then proceed with the refund of the order.
ARTICLE 13 – APPLICABLE LAW / DISPUTES
13.1. These Terms are available in English and French. In case of discrepancy, the French version shall prevail.

13.3. In the absence of a satisfactory response to Your complaint within one year following Your request to our customer service, You may have Your request examined by a mediator. In accordance with Article L.611-1 of the Consumer Code, any consumer has the right to free mediation to resolve the dispute that opposes them to a professional. 13.4. These General Terms and Conditions of Sale are governed by French law. In the event of a dispute or claim arising from or related to the sale of products through this website, including disputes concerning validity, interpretation, execution, or breach of these terms, and in the absence of a resolution of the dispute within the framework of the procedures provided for in Articles 11.1 and 11.2 of these terms, the dispute shall be exclusively subject to the jurisdiction of the competent courts of France.
Customers residing outside France expressly acknowledge and accept that by purchasing products on this website, they agree to submit any dispute concerning such purchases to the jurisdiction of the competent French courts.
